Unanimous Defense Verdict, Upheld on Appeal

(Kahn v. Vista Health, et. al., Mohave County Superior Court, CV2008-0858, 1 CA-CV 10-0667, petition for cert. denied)

Stacy defended Vista Health, a medical practice and its owners, in an employment law action brought by a former physician who alleged breach of contract and wrongful termination. The case was tried to a jury in Mohave Superior Court in January 2010.

The jury reached a unanimous defense verdict on all claims asserted against Vista Health and in favor of Vista Health on its counterclaim. The verdict was affirmed on appeal and the judgment was fully satisfied.

Summary Judgment Ruling Upheld on Appeal

(Five Points Hotel Partnership, et. al. v. First Arizona Title Agency, et. al. 2 CA-CV 2010-118)

In February 2011, Andrew convinced the Arizona Court of Appeals (Division Two) to uphold an award of summary judgment in his client’s favor. His client was sued in connection with a commercial real estate transaction.

In 2006, a sexual harassment case Stacy defended was listed as one of the top 10 defense verdicts in Arizona for that year.

Settlement of Religious Discrimination Suit

(EEOC v. DWW Partner’s LLP d/b/a/ Right Honda)

Stacy represented an individual who was harassed and wrongfully terminated by his employer based on his religious beliefs through the EEOC administrative process, litigation, and ultimate settlement.  The EEOC and Stacy jointly represented the individual during the litigation. The case settled the day EEOC filed suit.
